# Terms of Service **Last updated:** May 2026 These terms govern your use of Pensum, operated by Product Experience Group ("we", "us", "our"). By installing or using Pensum, you agree to these terms. ## The product Pensum is an Obsidian plugin with companion CLI and MCP server. It provides task management, meeting capture, project organization, AI features, and agent access within your Obsidian vault. ## Open source and licensing The Pensum plugin source code is licensed under the MIT License. You may view, fork, and modify the source code under the terms of that license. Pro features (meetings, AI, MCP server, CLI) are gated by a license check. A valid Pro license key is required to use these features. The license check is a runtime gate, not a modification of the MIT license that governs the source code. ## Free tier The Free tier is available to everyone, no account or license key required. It includes the full local productivity layer: tasks, projects, wiki, all views, capture surfaces, calendar, search, filters, subtasks, recurrence, and task cleanup. The Free tier may be used for personal or commercial purposes without restriction. ## Pro subscription ### Plans and pricing - **Pro BYO:** $9/month or $89/year. Bring your own API keys. - **Pro All-in-One:** $29/month or $279/year. AI included. Prices are in USD. Local currency equivalents are shown at checkout. ### Trial New users receive a 14-day free trial of Pro features. No credit card is required to start a trial. The trial begins when you first install Pensum. ### Payment Payment is processed by our merchant-of-record (Paddle or Lemon Squeezy), who handles billing, tax collection, and payment processing on our behalf. By purchasing a Pro subscription, you also agree to the merchant-of-record's terms of service presented at checkout. ### Cancellation You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until the period ends. ### Refunds We offer a 30-day money-back guarantee from the date of your first payment. If you are unsatisfied with Pro for any reason within 30 days of your initial purchase, contact support@pensum.dev for a full refund. Annual plans: refund requests within 30 days of purchase receive a full refund. After 30 days, no partial refunds are issued. ### License keys Each license key supports up to 5 devices. License keys are personal and non-transferable. Sharing license keys or circumventing the license check is a violation of these terms and may result in license revocation. ## AI features and API usage ### Pro BYO You provide your own API keys for Anthropic, OpenAI, or other supported providers. You are responsible for: - The cost of API calls made through your keys - Compliance with the API provider's terms of service - The security of your API keys (Pensum encrypts them locally but cannot prevent misuse if your device is compromised) Pensum is not responsible for charges incurred through your API keys. ### Pro All-in-One AI calls are routed through our infrastructure. Usage is subject to fair use. "Fair use" means personal productivity use consistent with the product's intended purpose. Automated bulk processing, resale of AI outputs, or usage patterns that materially exceed typical personal use may result in rate limiting or account review. ## Your data ### Vault data All vault data (tasks, notes, meeting recordings, transcripts, project files) stays on your device and is governed by your own data management practices. We have no access to your vault data. ### What we store We store: your license key, email address (from purchase), device identifiers, and aggregated license validation statistics. See our [Privacy Policy](/privacy/) for details. ### Data portability Your data is markdown files in your vault. You own them. Uninstalling Pensum leaves your vault fully functional. No export process is needed because there is nothing to export from our servers. ## Intellectual property Pensum, the Pensum logo, and the Pensum documentation are the property of Product Experience Group. The plugin source code is licensed under MIT. Content you create in your vault using Pensum is yours. We claim no ownership or license over your vault content. AI-generated content (meeting summaries, action items, stub expansions) is generated by third-party AI models (Anthropic, OpenAI). Ownership of AI-generated content is governed by the respective provider's terms. Pensum makes no independent claim on this content. ## Disclaimers Pensum is provided "as is" without warranties of any kind, express or implied. We do not warrant that the plugin will be error-free, uninterrupted, or compatible with all Obsidian versions or configurations. We are not responsible for: - Data loss caused by plugin bugs, sync conflicts, or vault corruption - Costs incurred through your AI provider API keys - Inaccurate AI-generated content (summaries, action items, transcriptions) - Incompatibility with other Obsidian plugins ## Limitation of liability To the maximum extent permitted by law, Product Experience Group's total liability to you for any claims arising from your use of Pensum is limited to the amount you paid for Pensum in the 12 months preceding the claim. ## Termination We may terminate or suspend your Pro license if you: - Violate these terms - Share or distribute license keys - Circumvent the license check - Use the product in a way that harms other users or our infrastructure You may terminate your use at any time by uninstalling Pensum and cancelling your subscription. ## Changes We may update these terms. Material changes will be communicated via plugin update notes and posted here. Continued use after changes constitutes acceptance. ## Governing law These terms are governed by the laws of the United States.
